This is the privacy policy of Feedback-Analytics B.V., registered with the Dutch Chamber of Commerce under number 69424810, with its registered office at Martinus Nijhoffweg 1 (2548 ER), The Hague. This document explains how Feedback-Analytics processes your personal data. Feedback-Analytics exercises the greatest care in processing your personal data. Obtaining personal data

When you use the services of Feedback-Analytics, you provide certain personal data to Feedback-Analytics yourself, or personal data is obtained from you in the context of the agreement. Personal data means all data relating to an identified or identifiable natural person.

Categories of personal data

Feedback-Analytics processes the following categories of personal data:

  • Personal, contact and address data, including date of birth, location data, phone number, email address;
  • Company data, including VAT number and Chamber of Commerce number;
  • Alternative delivery address;
  • Vehicle data, including licence plate data;
  • Financial data, including transaction data;
  • Account data, including your password and username;
  • Other personal data provided by you;
  • Data supplied by third parties.

Purpose of processing

The personal data processed by Feedback-Analytics is used to:

  • contact you to inform you about the services you have purchased and their performance;
  • perform its services;
  • improve its services;
  • process payments;
  • comply with legal obligations;
  • carry out marketing and communications, including improving the website by analysing visitor behaviour;
  • send newsletters;
  • make personalised offers;
  • exchange data with third parties for the performance of services, where necessary.

Legal basis for processing

Processing of personal data is only permitted on the following legal bases: (i) legal obligation, (ii) performance of a contract, (iii) (explicit) consent of the data subjects, and (iv) legitimate interest. When providing the services of Feedback-Analytics, personal data is processed. Feedback-Analytics only processes data that it considers necessary for (improving) the service and handles the (personal) data it has collected about you and your use of the services with care. The basis for processing this data is the agreement you have entered into with Feedback-Analytics. Your personal data may also be processed when you visit the website https://feedback-analytics.com or other web pages if you have given your consent for this.

Necessity of processing

The processing of your personal data is necessary to perform the services. The services offered by Feedback-Analytics cannot be fully performed without processing your personal data. If your explicit consent is required for specific purposes regarding the personal data, you must give this separately.

Automated decision-making

If there is any automated decision-making, this is carried out by computer systems and/or programs without human intervention. The data subject is responsible for the data they provide and which is used at the time of the automated decision. If the data proves to be incorrect or incomplete, any resulting damage is at the expense and risk of the data subject. This also includes failure to perform, or late or incorrect performance of, the agreement.

Retention period

The personal data processed by Feedback-Analytics is retained in accordance with relevant laws and regulations. If a longer retention period is required by law or regulation, the personal data will be retained longer in accordance with these requirements. All (obtained) personal data is retained no longer than strictly necessary.

Processing by third parties

Feedback-Analytics only shares personal data with third parties if this is strictly necessary for the performance of an agreement and to comply with relevant laws and regulations. No personal data is sold. Feedback-Analytics may be under a legal obligation to share personal data with third parties. When personal data is shared with third parties, processor agreements are concluded for this purpose.

The third parties with whom personal data is shared are:

  • The Payment Provider, for the performance of an agreement. The categories of personal data processed are financial data.
  • The Accountant, for the performance of an agreement. The categories of personal data processed are contact and address data and financial data.
  • Software suppliers, for the performance of the agreement. The categories of personal data processed are contact and address data.
  • Website administrator, for the performance of the agreement. The categories of personal data processed are contact and address data.
  • Engaged third parties, for the performance of the agreement. The categories of personal data processed are contact and address data.

Security of personal data

Feedback-Analytics takes the protection of your personal data seriously and takes appropriate technical and organisational measures to ensure a level of security appropriate to the risk, taking into account the state of the art, implementation costs, the nature, scope, context and purposes of processing, and the varying likelihood and severity of risks to the rights and freedoms of individuals.

Under 16?

If you are a minor, i.e. under 16 years of age, you may only give consent for the processing of your personal data with the consent of one of your parents or legal guardian. It is important that your parent(s) or guardian read this statement. They may also exercise the rights you have regarding the personal data you leave with us, such as the right to object to the (further) processing of your personal data or the right of access to and correction of your data.

Data subject rights

As a data subject you have the following rights:

  • Right of access: As a data subject you have the right to obtain confirmation as to whether or not your personal data is being processed and, where that is the case, to obtain access to that processing.
  • Right to rectification: You have the right to obtain rectification and completion of inaccurate data.
  • Right to erasure: A data subject shall have the right to obtain erasure of personal data concerning them without undue delay.
  • Right to restriction of processing: As a data subject you have the right to restriction of processing of your personal data. Contact Feedback-Analytics for this.
  • Right to data portability: A data subject has the right to receive the personal data concerning them which they have provided to Feedback-Analytics in a structured, commonly used and machine-readable format, and to transmit those data to a third party. A data subject may also instruct Feedback-Analytics to transmit these data directly to a third party.
  • Right to object: The data subject has the right to object at any time, on grounds relating to their particular situation, to the processing of their personal data, including profiling. Feedback-Analytics shall cease processing the personal data unless there are compelling legitimate grounds for the processing which override the interests, freedoms and rights of the data subject related to the bringing, exercise or defence of legal claims.

Complaints

If you have a complaint about how Feedback-Analytics handles your personal data, or wish to exercise any of the above rights, you can contact us via the website or by email at info@feedback-analytics.com. To ensure that you wish to exercise a right, Feedback-Analytics asks you to send a copy of your identity document. You may blacken your passport photo and MRZ (the strip of numbers at the bottom) to protect your privacy. Feedback-Analytics will respond to your request as soon as possible and no later than within 4 weeks.

You may also lodge a complaint with the Dutch Data Protection Authority. This is the competent supervisory authority. You can contact them via this link.

Changes to the privacy policy

Feedback-Analytics may amend the privacy policy at any time. The most recent version is published on the website. Always check the website for the most recent version. If the new privacy policy has implications for how Feedback-Analytics processes data already collected about you, Feedback-Analytics will inform you by email.

Use of social media
